Description

This determination arises from the authority's refusal to issue a code compliance certificate for a swimming pool and pool barrier on the basis that the balustrade to a stair and landing, which forms part of the barrier for the pool, does not comply with Clause F4 of the Building Code. The matter to be determined is whether the authority was correct to refuse to issue the code compliance certificate. In deciding this it must be considered whether the as-built barrier complies with Clause F4 of the Building Code.
