Description

This determination arises from the applicants wish to receive a code compliance certificate for the house; however the authority has stated that is not satisfied that the house complies with certain clauses of the Building Code. The authority's concerns about the compliance of the building work relate to weathertightness of the windows. The matter to be determined is therefore whether the authority is correct in the proposed exercise of its powers to refuse to issue a code compliance certificate. In deciding this matter, the following must be considered: 1-Whether the configuration of the joinery installed in the walls of the building complies with Building Code Clause B2 Durability and Clause E2 External Moisture. This includes the joinery itself, its junction with the external cladding and the way the components have been installed and work together; 2-Whether the elements that make up the building work comply with Clause B2 Durability of the Building Code, taking into account the age of the house. The authority has indicated it is satisfied that the building meets all other relevant clauses of the Building Code. This determination is therefore limited to the joinery/cladding configuration as described in paragraph 2.4.
