Description
This determination arises from the decision of the authority to refuse to issue a code compliance certificate for part of a house (the original house) that is 11 years old because it was not satisfied that the building work complied with certain clauses of the Building Code. The authority's concerns about the compliance of the building work relate to its age and weathertightness. The matter to be determined is therefore whether the authority was correct to refuse to issue a code compliance certificate in respect of the building consent for the original house. In deciding this, the following must be considered: 1-Whether the external claddings in the original house (the claddings) comply with Clause B2 Durability and Clause E2 External Moisture of the Building Code; 2-Whether the elements that make up the original house comply with Building Code Clause B2 Durability, taking into account the age of the house.
