This determination arose from the decision of the authority to refuse to issue a code compliance certificate and for a 7-year-old house because it was not satisfied that it complied with certain clauses of the Building Code.
The matter to be determined was whether the authority was correct in its decision to refuse to issue a code compliance certificate.
In making this decision, it was considered:
- Whether the external claddings to the house complied with Clause B2 Durability and Clause E2 External Moisture of the Building Code;
- Whether the building complied with the remaining clauses relevant to this house;
- Whether the elements that make up the building work complied with Building Code Clause B2 Durability, taking into account the age of the house.
