This determination arose from the decision of the authority to refuse to issue a code compliance certificate for an 11-year-old house because it was not satisfied that the building work complied with certain clauses of the Building Code.
The authority's concerns were limited to the compliance of steel frames to the garage and deck, and of an exterior retaining wall.
The matter determined was whether the authority was correct to refuse to issue a code compliance certificate.

- Whether the steel frames to the garage and deck of the house complied with Clause B1 Structure and Clause B2 Durability;
- Whether the exterior retaining wall complied with Clause B1 Structure and Clause F4 Safety from falling;
- Whether the elements that make up the building work complied with Clause B2 Durability, taking into account the age of the house.
