Description

This determination arose from the decisions of the authority to refuse to issue a code compliance certificate and to issue a notice to fix for a 5-year-old house because it was not satisfied that elements of the building work complied with certain clauses of the Building Code.

The authority's concerns about the compliance of the building work related to the weathertightness of the tiled decks to the house.

The matter determined was whether the authority was correct in its decision to refuse to issue a code compliance certificate and to issue a notice to fix for the building work.

It was considered whether the tiled deck membranes as installed on the building complied with Clause E2 External Moisture and Clause B2 Durability.
