Description

This determination arose from the decision of the authority to refuse to issue a code compliance certificate for a 9-year-old building containing eight townhouses because it was not satisfied that the building work complied with certain clauses of the Building Code.

The matter to be determined was therefore whether the authority was correct in its decision to refuse to issue a code compliance certificate.

In deciding this matter, it was considered:

  1. Whether the external claddings to the units  complied with Clause B2 Durability and Clause E2 External Moisture of the Building Code;
  2. Whether the elements that make up the building work complied with Building Code Clause B2 Durability, taking into account the age of the building.
