Description

This determination arose from the decision of the authority to refuse to issue a code compliance certificate for a 1-year-old house because it was not satisfied that it complied with certain clauses of the Building Code.

The refusal arose because it was not satisfied that the windows installed in the house complied with the weathertightness provisions of the code.

The matter to be determined was whether the authority was correct to refuse to issue a code compliance certificate in regard to the windows.

In deciding this, it was considered whether the window installation system complied with Clause B2 Durability and Clause E2 External Moisture of the Building Code.
