Description

This determination arose from the decision of the authority to refuse to issue a code compliance certificate for a 6-year-old building, because the building is part of a multi-unit development and it was not satisfied that the building work complied with certain clauses of the Building Code.

Based on the evidence available, the matters for determination were:

  1. Whether the claddings as installed complied with Clauses B2 Durability and E2 External Moisture;
  2. Whether certain building elements in Block G, other than the claddings, complied with the other relevant clauses of the Building Code;
  3. Whether the authority, in response to the owners' request, could amend the single building consent for the development, which includes Block G, so that Block G has its own separate building consent.
