Description

This determination arose from the decision of the authority to refuse to issue a code compliance certificate for an 11-year-old house because it was not satisfied that the house complied with certain clauses of the Building Code.

The matter to be determined was therefore whether the authority's decision to refuse to issue a code compliance certificate was correct.

In deciding this, it was considered:

  • Whether the external claddings to the house complied with the Building Code with regard to Clause B2 Durability and Clause E2 External Moisture;
  • Whether the building complied with the remaining Building Code clauses relevant to this house;
  • Whether the elements that make up the building work complied with Building Code Clause B2 Durability, taking into account the age of the house.
