This determination arises from the authority's decision to decline to issue a code compliance certificate for an 8-year-old a house because it was not satisfied that the building work complies with certain clauses of the Building Code as the building work had been undertaken under the supervision of a building certifier.
Based on the information available, the matters for determination, in terms of sections 177(a) and 188 of the Act are:
- Whether the external envelope of the house complies with Clause B2 Durability and Clause E2 External Moisture of the Building Code;
- Whether the elements that make up the building work comply with Building Code Clause B2 Durability, taking into account the age of the building work.
