Description

The matter for determination is whether the authority's decision to refuse to issue a code compliance certificate for a five-year old house is correct.

The authority has instead issued a certificate of acceptance that accepts the building's compliance, in full or in part, with certain clauses of the Building Code. The matters for determination, in terms of sections 177(a) and 188 of the Act are:

  1. Whether the external envelope of the house complies with Clauses B2 Durability and E2 External Moisture of the Building Code;
  2. Whether the remaining building elements comply with the relevant clauses of the Building Code;
  3. Whether the building elements comply with the Building Code Clause B2 Durability taking into account the age of the building work.
