Description

This determination arises from the decision of the authority to refuse to issue a code compliance certificate for a 10-year-old house because it was not satisfied that it complied with Clauses B2 Durability and E2 External Moisture of the Building Code.

The matters of non-compliance raised by the authority are restricted to the monolithic cladding and the age of the building work. There are no other matters in dispute.

Therefore, the matters for determination are:

  1. Whether the monolithic cladding as installed on the house ('the cladding') complies with Clause B2 Durability and Clause E2 External Moisture;
  2. Whether the building elements comply with Building Code Clause B2 Durability, taking into account the age of the building work.
