The matters for determination, in terms of sections 177(a) and 177(b) of the Act, are:

  • (a) whether the house complies with relevant clauses of the Building Code (First Schedule, Building Regulations 1992), and
  • (b) whether the decision by the authority to refuse to issue a code compliance certificate for the house was correct
