This determination arises from the decision of the territorial authority to refuse to issue a code compliance certificate for a house, which has taken 10 years to build, because it was not satisfied that the house complied with the Building Code (Schedule 1, Building Regulations 1992).
The matters for determination are: Whether the house complies with the relevant clauses of the Building Code (see sections 177 and 188 of the Act) and whether the elements that make up the building work comply with Clause B2 'Durability' of the Building Code, taking into account the age of the building work.
