The dispute for determination is whether the territorial authority's decision to decline to issue a code compliance certificate for a 10-year-old house because it was not satisfied that the building work complied with clause B2 Durability of the Building Code is correct. The matter to be determined is whether all the building elements installed in the house, apart from those items that may need to be fixed as set out in paragraph 5.4, comply with clause B2 of the Building Code considering the time that has elapsed since the elements were constructed.
