Description

The dispute for determination was whether the territorial authority's decision to decline to issue a code compliance certificate for a 6-year-old house because it was not satisfied that the monolithic cladding complied with clauses B2 - Durability and E2 -External Moisture of the Building Code, was correct.

The questions to be determined were:

  1. Whether the territorial authority's refusal to accept the validity of a code compliance certificate for the building that was issued by a building certifier under section 56 of the Building Act 1991 should be confirmed, reversed or modified.
  2. Whether the monolithic wall cladding as installed to the external walls of the building, complied with the Building Code.
