Description

The dispute for determination is whether the territorial authority's decision to decline to issue a code compliance certificate for the 3-year-old houses because it was not satisfied that the monolithic cladding complied with clauses B2 Durability and E2 External Moisture of the Building Code is correct. The questions to be determined is whether the wall cladding as installed to some of the external walls of the building complies with the Building Code (see sections 177 and 188 of the Act).
