Description

This is a determination of a dispute under Part 3 Subpart 1 of the Building Act 2004 made on behalf of the Chief Executive of the Department of Building and Housing.

The applicant is Wellington City Council. the other parties are the owner and the neighbours.

The application arises from a dispute about whether an addition to a house complies with the provisions of the building code for the protection of the neighbours' property. The matters to be determined are:

  • (a) Whether the building work concerned complies with clause C3 Spread of fire of the building code, and
  • (b) Whether the territorial authority's decision, under section 49 of the Act to grant a building consent for the work should be confirmed, modified or revoked.

Note: The determination refers to wording in clause C3 which is prior to the changes made in the 2012 amendments to the C clauses.
