Description

This was a determination by the Building Industry Authority of a dispute referred to it under section 17 of the Building Act 1991.

The applicants originally were the two owners of the property, however the new owner who purchased the property from them continued the determination. The other party was the territorial authority and the original owners were named as an 'interested party' subsequent to their disposing of the property.

The application arose from the refusal by the territorial authority to issue a code compliance certificate for a nearly new house unless changes were made to its monolithic cladding system.
