Description
This determination arises from the decision of the authority to issue a code compliance certificate for the construction of a new house.
The applicant holds the view that the building work as consented and as-built does not comply with the relevant clauses of the Building Code (First Schedule, Building Regulations 1992).
Though the determination application was initially in respect of the authority's decision to issue the code compliance certificate as well as the compliance of the building work it was later amended by the applicant to address only the compliance of the building work.
The matters to be determined are therefore:
- Whether the particular elements of the building work (specifically the veranda/roof junction and the exterior staircase) as proposed in the building consent would comply with the relevant clauses of the Building Code if built in accordance with the approved plans; and
- Whether particular elements of the building work as-built comply with the relevant clauses of the Building Code.
