Description
This determination arises from the decision of the authority to refuse to issue a code compliance certificate for additions and alterations to an administration building at a school.
The refusal arose because the building work was not inspected by the authority during construction and the authority considers it is therefore not able to be satisfied that the building work complies with the relevant clauses of the Building Code (First Schedule, Building Regulations 1992), in particular in regard to building elements that are no longer visible.
The matter to be determined is therefore whether the authority was correct in its decision to refuse to issue a code compliance certificate. In deciding this matter consideration must be given to whether there is reasonable grounds to be satisfied that the completed building work complies with the building consent.
