Description

This determination arises from the decision of the authority to refuse to issue a code compliance certificate for the 17-year-old alterations and additions to the house because it was not satisfied that the building work complied with certain clauses of the Building Code.

The authority expressed its concerns regarding compliance of a number of building elements and in relation to the weathertightness of its claddings. The matter to be determined is therefore whether the authority was correct to refuse to issue the code compliance certificate.

In deciding this, consideration was given to whether the additions and alterations comply with the Building Code to the extent required under section 112 of the Act.
