Description

This determination arose from the decision of the authority to refuse to issue a code compliance certificate for a 7-year-old commercial building because it was not satisfied that some elements of the building work complied with certain clauses of the Building Code.

The matter to be determined was whether the authority correctly exercised its powers of decision when it refused to issue a code compliance certificate.

In deciding this, it was considered whether the particular building elements identified by the authority complied with the following relevant Building Code clauses:

  • B1 Structure;
  • B2 Durability;
  • E2 External Moisture; and
  • G4 Ventilation.
