Description

The dispute arose from a decision of the authority to refuse to issue a building consent for a proposed change of use to an existing building from use SR Sleeping Residential to use SA Sleeping Accommodation.

The authority was of the view that the change of use proposal must include an emergency electrical power supply system for the lifts and rejected a proposed alternative solution that did not include a type 17 emergency electrical power supply system for the lifts.

The matter determined was whether the proposed alternative solution complied with the Building Code.
