Description

This determination arose from the decision of the authority to refuse to issue a code compliance certificate for an addition and alterations to a house because it was not satisfied that the building work complied with certain clauses of the Building Code.

The authority's primary concern was the length of time between when the building work was completed and the application for the code compliance certificate received, with regard to Clauses B2 Durability, E2 External Moisture and E3 Internal Moisture.

The matter to be determined was whether the authority was correct to refuse to issue a code compliance certificate for the building work.

In deciding this matter, it was considered:

1. Whether the addition and alterations complied with Clause B2 Durability and Clause E2 External Moisture of the Building Code;
2. Whether the tiled shower areas complied with Clause B2 Durability and Clause E3 Internal Moisture of the Building Code;
3. Whether the remaining building elements of the alterations complied with other relevant clauses of the Building Code;
4. Whether the building elements complied with Clause B2 Durability of the Building Code, taking into account the age of the alterations.
