Description

This determination arose from the decision of the authority to refuse to issue code compliance certificates for 15-year-old additions and 12-year-old alterations to an existing house because it was not satisfied that this building work complied with the Building Code.

The matter determined was whether the authority was correct to refuse to issue the code compliance certificates.

It was considered:

  1. Whether the external envelope of the additions and the alterations complied with the Clauses E2 External Moisture and B2 Durability;
  2. Whether the additions and the alterations complied with the other relevant Building Code Clauses;
  3. Whether the elements that make up the building work complied with Clause B2 Durability, taking into account the age of the building work.
