Description

The determination arose from the following decisions by the authority to:

  • refuse to issue a code compliance certificate and to issue a notice to fix for the house, because it was not satisfied that the building work complied with certain clauses of the Building Code;
  • to issue an amended building consent for remedial work to the house; and
  • refuse to approve the proposed remedial work to the window jambs.

The application for this determination was because the authority was not satisfied that the proposed method of repairing the window jambs would comply with Clauses B2 Durability and E2 External Moisture.

The matter determined was therefore whether the window jamb modifications proposed by the consultant would comply with Clause E2 External Moisture and Clause B2 Durability, insofar as it relates to the weathertightness of the window jambs.
