Description

This determination arose from the decision of the authority to refuse to issue code compliance certificates for the building work carried out under two building consents because it was not satisfied that the house complied with certain clauses of the Building Code.

The matter determined was whether the authority was correct in its decision to refuse to issue the two code compliance certificates.

It was considered:

  1. Whether the external claddings to the house complied with Clause B2 Durability and Clause E2 External Moisture;
  2. Whether various other elements in the building work complied with the relevant clauses of the Building Code;
  3. Whether the elements that make up the building work complied with Clause B2 Durability, taking into account the age of the house.
