Description
This determination arose from the decision of the authority to refuse to issue a code compliance certificate for a four year old house, because it was not satisfied that the building work complied with certain clauses of the Building Code.
The initial reason for the refusal was that the authority believed that adequate inspections of certain elements had not been carried out during construction. The authority subsequently added further reasons for its refusal.
The matter to be determined was whether the authority was correct to refuse to issue a code compliance certificate.

- Whether the external claddings to the house complied with Clause B2 Durability and Clause E2 External Moisture; and
