Description
This determination arose from the decision of the authority to refuse to issue a code compliance certificate for a five-year-old house because it believed that adequate inspections were not carried out during construction of the house and it could not be satisfied that the building work complies with certain clauses of the Building Code.
The matter determined was whether the decision of the authority to refuse to issue the code compliance certificate was correct.
The following was considered:
- Whether the external envelope to the house complied with Clauses B2 Durability and E2 External Moisture;
- Whether the building complied with the remaining clauses relevant to this house;
- Whether the elements that make up the building work complied with Clause B2 Durability, taking into account the age of the house.
Although not specifically requested, this determination also considered whether it wass reasonable to issue a code compliance certificate or a certificate of acceptance.
