This determination arises from the decision of the authority to refuse to issue a code compliance certificate ('CCC') for a 2 year old building because it could not be satisfied on reasonable grounds that the unpainted soffit lining complies with Clauses E2 External moisture and B2 Durability of the Building Code (Schedule 1, Building Regulations 1992).
The matter for determination is whether:
- The soffit lining as installed on the building complies with Clause E2 External moisture and Clause B2 Durability with respect to their weathertightness; and
- The decision by the authority to decline to issue a CCC was correct.
