Description

This determination arises from the decision of the authority to issue a notice to fix and refuse to issue a code compliance certificate for a 4-year-old house because it was not satisfied that the wall cladding as installed to the house complied with certain clauses of the Building Code.

The matter to be determined is therefore whether the authority's decisions to issue a notice to fix and to refuse to issue a code compliance certificate were correct.

In making these decisions, it must be considered whether the timber board and batten cladding to the house ('the cladding') complies with Clause B2 Durability and Clause E2 External Moisture of the Building Code. The cladding includes the timber boards and battens, the windows, the fixings and flashings, as well as the way the components have been installed and work together.
