Refusal to amend a building consent and compliance of certain building elements at a house at 10 Tikorangi Road, Opito Bay
Scope
The determination arose from a dispute over the remedial work required to a two-year-old house.
The matters for determination were:
- whether certain building elements installed in the house comply with the requirements of the Building Code and
- whether the decision of the authority to refuse to amend a building consent is correct.
The authority had approved remedial work for repairs to the basement walls of the house but was not satisfied that it has sufficient evidence that the balance of the work proposed in the application for the amendment to the building consent would achieve compliance with Building Code Clauses B1 Structure, B2 Durability, and E2 External Moisture.
