Description

The matter for determination, under section 177(b)(i) of the Act, is whether the authority's decision to refuse to issue a code compliance certificate for the house was correct.

The authority's decision arose because it was not satisfied that the house complied with certain clauses of the Building Code. In order to determine this matter, it must be considered under section 177(a) of the act:

  1. Whether the external envelope for the house complies with Clause B2 Durability and Clause E2 External Moisture of the Building Code;
  2. Whether the building elements comply with Building Code Clause B2 Durability, taking into account the age of the building work.
