This determination arises from the decision of the authority to refuse to issue a code compliance certificate for a 2-year-old house because it was not satisfied that the cladding complied with Clauses B2 and E2 of the Building Code.
The matter for determination, in terms of section 177(a) and 177(b) of the Act are:
- Whether the cladding as installed on the house complies with Building Code Clause B2 Durability and E2 External Moisture;
- Whether the authority was correct in its decision to refuse to issue a code compliance certificate.
