This determination arises from the decision of the authority to issue a code compliance certificate, which it now wishes to withdraw, in respect of a new house.

The matter for determination in terms of sections 177(a) and 177(b)(i) of the Act is whether the authority was correct in issuing a code compliance certificate for the house.

In order to determine this matter it has been considered whether the building is code-compliant, and whether it was constructed in accordance with the building consent.
