This determination arises from the decision of the authority to refuse to issue a code compliance certificate for 3 to 9-year old alterations and additions to a house because it is not satisfied that the building work complies with certain clauses of the Building Code (First Schedule, Building Regulations 1992).
The matters for determination are:
- Whether the surface water and foul water drainage systems, as installed in the alterations, comply with Clause E1 Surface Water and Clause G13 Foul Water of the Building Code;
- Whether the cladding as installed on the addition ('the cladding') comply with Clause B2 Durability and Clause E2 External Moisture of the Building Code;
- Whether the elements that make up the building work comply with Building Code Clause B2 Durability, taking into account the age of the additions.
