Description

The matter for determination is whether the territorial authority's decision to decline to issue a code compliance certificate for 5-year-old alterations to a house is correct.

The refusal arose because the building work had been undertaken under the supervision of Prime Building Compliance Ltd ('the building certifier'), which was duly registered as a building certifier under the former Building Act 1991 but which had limitations imposed on its scope of approval with regard to compliance with E2/AS1 for residential buildings before it issued a code compliance certificate for the building work.
