The matter for determination is whether the territorial authority's decision to decline to issue a code compliance certificate for a 4-year old house, because it cannot be satisfied that the building work as a whole complies with the Building Code, is correct.
The refusal arose because the building work had been undertaken under the supervision of the building certifier which was duly registered as a building certifier under the former Building Act 1991, but which lost its approval to undertake projects of this monetary value before it had issued a code compliance certificate for the building work.
