The matter for determination was whether the territorial authority's decision to decline to issue a code compliance certificate for the alterations and additions was correct.

The refusal arose because the building work had been erected under the supervision of the building certifier who did not issue a code compliance certificate for the house, and when asked to make a final inspection, the territorial authority refused to do so.

The territorial authority considered that the appropriate certificate to be issued was a certificate of acceptance, as it could not be satisfied that the building as a whole complied with the Building Code.
