Description

The application for a determination arises from notices under section 124 of the Act issued by the territorial authority in respect of eight houses in Matata that were affected by landslips and associated flooding in the Awatarariki catchment. The territorial authority stated the matter for determination as being the Applicant's exercise of its power to deal with dangerous buildings as follows: Are the buildings dangerous in terms of section 121 of and if the buildings are dangerous, should the Council exercise its power under section 124 of the Act to require the buildings to remain unoccupied until mitigation works are undertaken to reduce the danger?
