Description
The dispute for determination was whether the territorial authority's decision to decline to issue a code compliance certificate for a 10-year-old house because it was not satisfied that the vertical boards and battens to the walls of the house complied with clauses B2 Durability and E2 External Moisture of the Building Code and other elements of the building complied with clause B2.
The questions to be determined were:
- Whether the board and batten cladding as installed to the walls of the building complied with the Building Code (see sections 177 and 188 of the Act).
- Whether certain building elements, which have 5 or 15-year, or the life of the building, being not less than 50 years, durability requirements, complied with clause B2 of the building code considering the time that elapsed since the elements were constructed.
