The dispute for determination was whether the territorial authority's decision to decline to issue a code compliance certificate for a 7-year-old alteration to an existing house because it was not satisfied that the monolithic cladding complied with clauses B2 Durability and E2 External Moisture of the Building Code was correct.
The questions to be determined, therefore, was whether:
- The monolithic wall cladding as installed to the external walls, columns and beams of the building complied with the Building Code
- All other elements incorporated in this building complied with clause B2 of the Building Code, considering the time when the house was constructed.
