This is a determination under section 17 of the Building Act 1991 as amended by section 424 of the Building Act 2004 made on behalf of the Chief Executive of the Department of Building and Housing.
The applicants are the owners of the other property concerned acting through a firm of solicitors. The other parties are the owner of the house and the territorial authority concerned.
The determination arises from a dispute about a building consent for the construction of a house on the seafront, and specifically whether the house will comply with the building code in respect of protecting certain other property against coastal hazards.
