Description

This is a determination under Part 3 Subpart 1 of the Building Act 2004 made on behalf of the Chief Executive of the Department of Building and Housing.

The applicant is the owner, and the other party is the Rodney District Council

The application arises because the territorial authority declines to issue a code compliance certificate for a 2-year-old house, unless changes are made to its monolithic cladding system.

The question to be determined is whether the monolithic wall cladding as installed to the timber-framed external walls and columns of the house, complies with the Building Code (see sections 177 and 188 of the Act).
