This was a determination by the Building Industry Authority of a dispute referred to it under section 17 of the Building Act 1991. 

The applicants were the owners of the property, acting through the builder as their agent and the other party was the territorial authority.

The application arose from the refusal by the territorial authority to issue a code compliance certificate for a new house unless changes were made to its monolithic cladding system.
