Description

This determination arises from the decision of the authority to refuse to issue a code compliance certificate for an 8-year-old house because it was not satisfied that the building work complies with the requirements of the building consent documents and certain clauses of the Building Code (First Schedule, Building Regulation 1992).

The authority's concerns about the compliance of the building work relate primarily to the weathertightness and durability of the exterior claddings. The matter to be determined is therefore the authority's exercise of its powers of decision in refusing to issue the code compliance certificate for the reasons set out in its letter dated 1 October 2015.
