Description

This determination arises from the decision of the authority to issue an earthquake-prone building notice under section 124(1)(c) as the authority considered the building to be earthquake prone as defined in section 122 of the Act.

The applicant considers the authority's earthquake-prone building policy is not consistent with section 122 of the Act, that it did not correctly apply its policy in the case of this building, and that the authority failed to consider all the relevant information available at the time.

The matter to be determined is therefore whether the authority exercised its powers correctly in issuing the section 124 notice for the building.
