Description

This determination arose from the decision of the authority to issue a building consent for the recladding of a house subject to certain requirements.

The applicants considered the authority had placed conditions on the consent that it was not legally entitled to do so; in particular the requirement for a quality assurance plan in respect of 'timber remediation' to form part of the consent application and what the applicants considered to be a 'narrow band of selective experts' that the authority would accept as being adequately experienced or qualified.

The matter to be determined was therefore whether the authority was correct in the exercise of its powers of decisions to in respect of the conditions included in the issued building consent.
